Police are looking for a man accused of attempted murder after an altercation ended with gunfire on Monday evening, Nov. 29

Officers were dispatched to a residence on Jubal Court for a report of shots fired in the area of Maag Avenue and Jubal Court shortly before 9 p.m. Monday. When they arrived they discovered multiple subjects standing in front of the residence. According to the victims, the ex-boyfriend of the female victim, identified as David Nyberg, 21, came to the residence requesting property he’d left there. The property was returned but Nyberg brought several friends with him to retrieve the property and one of Nyberg’s friends, Michael Dietz, 20, got into a minor argument with one of the victims as they were leaving.

As Dietz was getting into Nyberg’s vehicle, which was parked across the street from the victim’s car and home, the victims noticed Dietz was brandishing a handgun. As the victims sought cover in their vehicle, Dietz began firing. The male victim shielded the woman with his body. Five shots were fired and three struck the victim’s truck and one struck the female victim’s home, where her father and young brother were.

Modesto Police arrested Nyberg when he attempted to drive to his Modesto home. He was booked on charges of attempted murder. Dietz was not located and is wanted by the Oakdale Police Department for the same charge.

Dietz is described as 6 feet tall, 145 pounds, with blonde hair and hazel eyes.
