Oakdale Man Arrested For Sex Rendezvous With 13-Year-Old

Oakdale Police arrested a local man on Tuesday, Dec. 24, on suspicion of an array of sexual assault charges regarding a 13-year-old girl he met on Facebook.

The parents of the girl had reported her as a runaway in Turlock and, after checking her Facebook account, learned she may be with a man named David Garcia, who was approximately 22 years old, and lived in Oakdale. Facebook messages showed they may have made arrangements to meet in person.

On Sunday, Dec. 21, Turlock Police advised Oakdale Police about the incident. Investigators then used in-house records to locate a David Garcia Jr, 24, of River Bluff Court. When contacted at his residence by officers, Garcia denied knowing the girl.

Later that day, the girl’s parents located her and learned that she spent the night with Garcia at the River Bluff Court residence. Police said she was taken to a local hospital where a forensic sexual assault exam was conducted.  

Detectives believe Garcia met the girl at a shopping center in Turlock on Saturday, Dec. 20, then drove her to his home in Oakdale for the purpose of having sexual relations with her then drove her back to Turlock Sunday morning.

Police stated that although the girl went with Garcia willingly, because of her age she is legally unable to give consent to the types of acts that occurred when they were together.

After further investigation into the case, Oakdale police detectives contacted Garcia at his home on Dec. 24 and arrested him for felony charges of kidnapping, rape of a person unable to give consent, oral copulation on a victim under 14 years of age, and penetration with a foreign object.

Oakdale Police said the kidnapping charge applied because the victim was under 14 and Garcia transported her to another area for the purpose of sexual relations.

Garcia was booked at Stanislaus County Jail with his bail was set at $500,000.
