Wary Of Ordinance Changes

Dear Editor,
In addition to this letter to you, I have addressed the same letter (and other legal materials) to Jerome E. Horton, chair of the California Board of Equalization, as well as George Runner, Oakdale’s astute elected representative on the BOE. And, to Ms. Donna Puchaiski of the staff of the State Board of Equalization, local revenue allocation section.
The City of Oakdale City Clerk responded to my request for public records regarding the sales tax increase with information showing that she now displays the content of that tax measure as “Ordinance No. 1202 (Amended).” The word amended is what has been added.
City Clerk Nancy Lilly always does well for us and this is just more of her good, proper, work. She does not hide things. But, there is a problem at City Council. Consider this. The document of the “amended” ordinance designed to increase our taxes is, I believe, illegal, highly so. This is why.
The final paragraph of the “amended” ordinance claims this; this exact quote:

“The foregoing ordinance No, 1202 amendment was introduced at a regular meeting of the Oakdale City Council on the 17th. day of October, 2011 and finally adopted on the 7th day November by the following vote: Ayes, Brennan, Dunlop, Howard, Morgan, Paul.”

What makes it illegal is that the ordinance, it is my belief, was changed after it was introduced and those changes were never advertised. They were kept hidden because legal time had run out for changes. They were never made known to citizens who don’t have and use computers to read agendas.
I’m going to place this in the form of a request to the Civil Grand Jury Judge for investigation by that Grand Jury. I have all the files. City Council members are not protected from sworn testimony before any form of Grand Jury, criminal or civil.
The time has come for Ex-Mayor Farrell Jackson to step in and help. There are two seats on Council up for election in November of 2012, the seats now held by Tom Dunlop and Kathy Morgan, but I’ve no way to know who is healthy enough to run again, yet I’m pretty sure Farrell Jackson could do so and help this city and help Pat Paul, too. Help his city. My city. Your city.
