An Oakdale resident pleaded no contest to the December 2012 rape of a 16-year-old girl as part of a plea agreement on Tuesday, Nov. 12 in Stanislaus County Superior Court.

A “no contest” plea carries the same penalty and has the same legal effect as pleading guilty without actually admitting any guilt.

Timothy Lyman, 45, knew the victim through a local soccer league that she participated in within Oakdale.

Judge Marie Silveira sentenced Lyman to one year in jail and three years probation. As a result of the conviction, Lyman will have to register as a sex offender.

In return for the plea to the rape, the district attorney’s office dismissed charges of unlawful sexual intercourse with a minor, unlawful sexual intercourse with an unconscious person, oral copulation of a minor, and a misdemeanor charge of contributing to the delinquency of a minor.

Lyman was taken into custody to serve his sentence at the conclusion of Tuesday’s court hearing.

Lyman, who is divorced with a teenage daughter the same age as the victim, hosted a party at his H Street Oakdale home on Dec. 26, 2012. Lyman was the only adult on the premises for the party where he served alcohol to local teens that attended.

Lyman was accused of having sex with the teenaged victim after she had passed out in a bedroom of Lyman’s Oakdale home.

The victim reported that she awoke to find Lyman having sex with her and also performed oral sex on her.

During the investigation Lyman, self-employed, told police he was a soccer coach of the girls. Those associated with the soccer league have said Lyman was not a coach, only an involved parent.

Terms of Lyman’s probation stipulate that he will not be allowed to possess pornography or be in the company of minors. Lyman must also undergo sex-offender counseling.
